Terms of Use

These terms and conditions constitute a binding agreement between you and Insights.ge / "Insights Consulting" LLC (hereinafter the "Company") and govern only your use of the Insights.ge website and its application. The website and/or related services, including any communication carried out by the Company towards clients in connection with the offered services, are hereinafter jointly referred to as the Insights.ge platform;
Any personal information that the Company obtains from you or from third parties is processed in accordance with the rules set out in the "Personal Data Protection Policy" published on the website, which forms an integral part of this agreement;
By agreeing to the Insights.ge Terms of Use, you also agree to the Insights.ge Personal Data Protection Policy;
Since the user wishes to open a personal account on the platform operated by Insights.ge, in order for the user to receive services through the platform and for the Company to provide its services, the Company and the user agree to enter into an agreement, on the basis of which the following will take place:
The opening of an account by the user, the provision by Insights.ge of services placed on its platform to the user, the payment of fees by the user, and the closing of the account;

Every user who wishes to use the Insights.ge website is obliged to agree to and comply with the terms and conditions set out below. The administration of Insights.ge reserves the right, at any time and unilaterally, by publishing on this website, to amend these terms without requiring further additional consent from the user.

1. Definitions

1.1. Terms and definitions used in these terms have the meaning set out below, unless the context of the document clearly indicates otherwise:

1.1.1. Account – a personal account registered by the user on the website;
1.1.2. Authorization – means access by the user to their personal account, and includes any action defined under Article 6 of these terms and conditions;
1.1.3. Terms of Use – means these terms, together with any other rules and/or conditions that these Terms of Use identify by reference as forming part of these terms, and which govern the user's access to and use of the website, including anything related to any content, function, or service offered on the website;
1.1.4. Website – means Insights.ge, through which the services are offered;
1.1.5. User – a natural person who meets the requirements set out in these terms and wishes to purchase the Company's products/services through the Insights.ge platform;
1.1.6. Company – "Insights Consulting" LLC / Insights.ge, registered and existing in accordance with the legislation of Georgia (registered in 2023, identification number 405611716, legal address: Shartava St. 35/37, 66;
1.1.7. User, users – means a user registered on the Insights.ge website;
1.1.8. Parties – means the Company and its user;
1.1.9. Insights.ge platform – the platform operated by Insights.ge, which, without limitation, includes the Insights.ge website;
1.1.10. Transaction – any transaction carried out by the user in connection with their personal account and/or the services;
1.1.11. Universal identifiers – a set of data provided to the user by Insights.ge, using which the user registers in the identification system and is thereby given the ability to make use of the services offered by Insights.ge;
1.1.12. Access code(s) – codes, passwords, username, identification code, universal identifiers and/or other confidential information that Insights.ge may provide to the user for access to various services;
1.1.13. Agreement – the agreement concluded between the user and Insights.ge, which includes these terms and conditions, the Personal Data Protection Policy, and annexes, if any;
1.1.14 Subscription fee – a fixed payment (amount) set by Insights.ge for a specific service for a particular billing period;

1.2. Where the context so permits, words denoting the singular include the plural and vice versa.

2. Representations and warranties

By agreeing to these terms and conditions, the user confirms that they:

2.1 are a natural person who has reached the age of 18 and has legal capacity;
2.2. have full (unrestricted) legal capacity, are not under the influence of narcotic, alcoholic, psychotropic or toxic substances, are not under the influence of mistake, fraud, pressure, threat or any other unlawful influence, and are not the target of violence, threats, deception, misleading conduct or any other prohibited act by Insights.ge or any third party, and fully understand the content of their expression of will, the substance of the provisions of these terms, and the legal consequences arising from them;
2.3. have full authority (or will obtain the relevant authority) to sign and perform the obligations set out in these terms or in any other agreements and representations;
2.4. have read and understood the terms and that these terms are acceptable to them;
2.5. all data provided by them is accurate;
2.6. the user is not engaged or participating in any unlawful activity prohibited under the legislation of any jurisdiction (including the legislation of Georgia and the legislation of the country of which the user is a citizen), including money laundering, arms trafficking, terrorism or any other unlawful activity;
2.7. at the time of opening the personal account and throughout the term of the agreement, their activity and/or conduct is/will be in compliance with local and/or international legislation;
2.8. their conduct is not/will not be directed at deceiving Insights.ge and/or any third party. Taking this principle into account, for the purposes of concluding or performing the agreement, any document and/or information submitted by them to Insights.ge is/will be, at the time of its submission, true, accurate and complete;
2.9. they will perform the obligations undertaken under these terms in good faith, fully and properly;
2.10. they agree that, after opening the personal account and until termination of the agreement, Insights.ge may search for/verify and process any information specified by or related to the user, including personal information and/or universal identifiers;
2.11. the user will immediately notify Insights.ge in writing of any circumstance(s) that may contradict these representations and/or cause a breach of the aforementioned warranties;
2.12. Insights.ge enters into the agreement relying on the representations, warranties and obligations set out in these terms and treats them as terms of the agreement. Accordingly, following the conclusion of the agreement, a breach of the representations, warranties and obligations set out in this article is sufficient grounds for Insights.ge to unilaterally refuse to provide all or any of the services envisaged by the agreement and these terms.

3. To make use of the full range of Insights.ge services

3.1 the user registers on the Insights.ge website;
3.2 for registration, the user provides their first name, last name, email address and a password known only to them; the system does not store it in plain form but stores its hashed version, which is not accessible to anyone other than its owner;
3.3 to complete registration and/or the purchase of a service, the user must check a box confirming their agreement to the Insights.ge Personal Data Protection Policy. This box may already be checked, for the purpose of user convenience and to simplify the process;
3.4 after completing registration, the user may select their preferred service on the website;
3.5 to purchase a service, the user may be asked to provide additional information: personal ID number, mobile phone number, actual address, etc.;
3.6. the Company has the right to cancel the registration and the user's account if a violation of the requirements set out in this agreement or by law, or bad-faith conduct, is identified;

4. Registered universal identifiers

4.1. Username – one of the parameters required to receive services and to carry out authorization, automatically determined by the centralized identification system;
4.2. Password – one of the parameters required to carry out authorization in order to receive the centralized remote service, which the user determines for themselves upon registration in the centralized identification system, via a remote service channel(s) selected by Insights.ge or another communication channel. The password is subject to subsequent renewal/change at the user's discretion;
4.3. User's personal ID number – identification number;
4.4. User's email address – a unique identifier and email address to which the user receives the access codes and passwords (if any) needed to carry out operations defined under the centralized remote service. To receive the centralized remote service, the user may be required to carry out authorization using a simple method (username and password) or a complex method (username, password and one-time code). The authorization method is also registered in the centralized identification system for each relevant remote service channel(s)/service used;
4.5. For the purposes of improving services and/or security, the Company may determine additional or different user identifiers.

5. Authorization

5.1. After registering an account, the user undergoes authorization, which is required in order to make use of the full range of services on the website (having a profile/account and the functions related to it);
5.2. Authorization is carried out by means of the user's universal identifiers.

6. Purchase of the desired service by the user

6.1. With or without authorization, the user can access various information and purchase a service via the navigation buttons placed on the site.
6.2. Using the search function or other navigation buttons placed on the website, the user selects the category of service they want.
6.3. The user can purchase a service using one of two different methods, a standard method and a fast method (hereinafter the "fast method" or the "standard method"):
6.4. When purchasing by one method:
- 6.4.1. the user selects and places their desired product in their own cart by clicking the button designated for this purpose.
- 6.4.2. after placing the product in the cart, the user is redirected to the purchase and checkout page, where various service fees (e.g. delivery, installment surcharge) may be added to the product's price, and the user places the order.
6.5. When purchasing by the other method:
- 6.5.1. the user selects their desired product and clicks the "quick purchase" button.
- 6.5.2. after clicking the button, an additional window appears where the user selects the payment method. In the case of payment by bank card, the user is redirected to the purchase page, where the process continues in accordance with the standard method. If another payment method is selected, the user fills in the requested information and confirms the order. After that, in order to complete the necessary additional information, they will be contacted by the Company's
6.6. The user will be able to receive the products purchased through the Insights.ge platform within 1-2 business days in Tbilisi, and within 3-5 business days in the regions, from the moment the payment is reflected in the Company's account.
6.7. The user has the right to return or exchange a purchased item in accordance with the attached return/exchange policy (Articles 8 and 9).
6.8. Delivery of purchased products is carried out to all regions of Georgia that the user can select on the purchase page.
6.9 Payment is carried out using the following methods:
6.10 Depending on the delivery method chosen on the purchase page, payment may be made by bank card and online transaction, or by bank transfer.

7. Settlement between Insights.ge and the user

7.1. The user may make payment by credit card, which entails agreement to these terms and conditions.
7.2. When paying by credit card, the recipient of the transfer is the Company.
7.3 The user's obligation towards the Company is considered fulfilled from the moment the value of the specific service is fully reflected in the Company's relevant bank account.
7.4 The user makes payment to Insights.ge using a VISA or MASTERCARD card on the Insights.ge website.
7.5 When purchasing a service that provides for use of the service within a specific period, the user is obliged to pay the subscription fee.
7.6 The calculation and payment of the subscription fee is carried out in accordance with the conditions set out for the individual service.
